Attorney Workflow

Prepare. Mediate. Move the case forward.

01

Prepare the Matter

Identify the issues that genuinely require resolution,
gather the information that affects those issues, and
determine where meaningful movement may be possible.

02

Use the Session Well

Mediation creates a structured setting for counsel and
clients to test positions, evaluate options, and work
toward agreement without requiring every issue to resolve.

03

Document the Progress

Complete resolution is one outcome. Partial agreements,
narrowed disputes, and clearly defined remaining issues
can also move the matter forward.

Help the Session Move

Good mediation starts before the conference.

Focus

Define the Issues That Actually Need Resolution

Separate the central disputed questions from background
conflict so the session can focus on decisions that matter.

Information

Bring What Changes the Conversation

Financial records, parenting information, proposed terms,
and other material should help evaluate the disputed issue,
not simply enlarge the record.

Strategy

Separate Litigation Position From Settlement Objective

A strong legal position and a workable negotiated outcome
are not always the same thing. Mediation creates room to
evaluate both.

Movement

Know Where Flexibility Exists

Identifying priorities, decision points, and acceptable
alternatives helps counsel use mediation time more
productively.

Progress

Use Partial Agreement Productively

Resolving some issues can reduce litigation pressure,
narrow later proceedings, and clarify what still requires
decision.

Role

Counsel Remain Counsel

Attorneys continue to advise and advocate for their clients.
The mediator remains neutral and does not replace counsel
or impose a result.

Scheduling & Preparation

What happens before the session

01

Submit the Matter

The intake process collects information about the
parties, participating counsel, the nature of the
dispute, anticipated mediation needs, and preferred
dates.

02

Confirm Scheduling

Requested dates remain subject to availability until
the applicable payment process is completed and KSL
confirms the mediation.

03

Prepare Materials

The Care Team provides current submission instructions
and applicable deadlines for confirmed mediations so
materials can be reviewed before the session.
